ORDINANCE NO. 609
AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CYPRESS ADDING ARTICLE VI TO CHAPTER 5 OF THE
CODE OF THE CITY OF CYPRESS RELATING TO THE REMOVAL
OF GRAFFITI.
WHEREAS, it has come to the attention of the City Council of the
City of Cypress that certain areas within the City have an unkept appear-
ance due to the presence of graffiti or other inscribed material on the
real property or improvements in these areas; and
WHEREAS, Government Code Section 53069.3 enables a city to enact
an ordinance to provide for the use of City funds to remove graffiti
or other inscribed material from public or privately owned permanent
structures located on public or privately owned real property within
the City; and
WHEREAS, the removal of graffiti and other inscribed material from
public or privately owned permanent structures located on public or
privately owned real property within the City will add to an environ-
ment which the City Council is desirous of maintaining in the City of
Cypress.
NOW, THEREFORE, the City Council of the City of Cypress DOES ORDAIN
as follows:
SECTION 1. Article VI is hereby added to Chapter 5 of the Code of
the City of Cypress relating to the removal of graffiti:
ARTICLE VI.
REMOVAL OF GRAFFITI
Sec. 5 -26. Presence of graffiti or other inscribed material.
The City Council of the City of Cypress hereby finds that
graffiti or other inscribed material on public or privately owned
permanent structures located on public or privately owned real
property within the City of Cypress is obnoxious to the public
health, safety, and general welfare of the community and citizens
of the City of Cypress.
Sec. 5 -27. Removal of graffiti or other inscribed material.
The City Council of the City of Cypress authorizes the
Director of Public Works or his designate to remove graffiti
or other inscribed material from any and all structures owned
by the City of Cypress.
The Director of Public Works or his designate is authorized
to remove graffiti or other inscribed material from privately
owned permanent structures only after securing the consent of
the owner of the permanent structures.
Nothing in this section shall authorize the Director of
Public Works or his designate to paint or repair a more extensive
area than is necessary to complete the removal of the graffiti
or other inscribed material itself.
SECTION 2. This Ordinance is an Urgency Ordinance passed and adopted
pursuant to Government Code Section 36934 and shall take effect immediately
upon introduction and adoption in that the presence of graffiti and other
inscribed material on publicly and privately owned permanent structures

within the City of Cypress is a material detriment to the community and
citizens of the City of Cypress and, in order to promote the general
health, safety, and public welfare of the community and citizens of
the City of Cypress, immediate action must be taken to remove said
graffiti and other inscribed material.
PASSED AND ADOPTED by the City Council of the City of Cypress at
a regular meeting held on the 12th day of December 1977.
