ORDINANCE NO. 617
AN ORDINANCr OF THE CITY COUNCIL OF CYPRESS
APMENDING ChAPTER 19, CONSISTING OF SECTION
19 -1 AND 19 -2, AND DELETING ARTICLE IV SECTION
5 -12, 5 -13, 5 -14, AND 5 -15, OF CHAPTER 5 OF ThE
CYPRESS CITY CODE, THEREBY ADOPTING BY REFERENCE
THE FOLLOWING CODES: ThE 1976 EDITION OF THE
UNIFORM PLUMBING CODE INCLUDING THE 1976 EDITION
OF UNIFORM SWIMMING POOL CODE AND ThE 1976 EDITION
OF TEL UNIFORM SOLAR ENERGY CODE INCLUDING INSTALL -
ATION AND MATERIAL STANDARDS.
THE CITY COUNCIL OF THE CITY OF CYPRESS DOES ORDAIN AS FOLLOWS:
SECTION 1: Article IV Sections 5 -12 thru 5 -15 of Chapter 5 of the
Cypress City Code are hereby repealed.
SECTION II: Section 19 -1 of Chapter 19 of the Cypress City Code is
hereby amended to read as follows:
SECTION 19 -1 Uniform Plumbing Codes - Adopted; where filed
The following are hereby adopted by reference, as the
Plumbing Code of the City of Cypress, three (3) copies of
each which are on file in the office of the City Clerk:
(a) The Uniform Plumbing Code, 1976 Edition and
appendices;
(b) The Uniform Plumbing Code Material and
Installation Standards; and
(c) Uniform Swimming Pool Code, 1976 Edition.
(d) Uniform Solar Energy Code, 1976 Edition.
SECTION III: Section 19 -2 of Chapter 19 of the Cypress City Code
is hereby amended to read as follows:
SECTION 19 -2 Uniform Plumbing Code - Amendments, Additions,
and Deletions.
The following amendments are made to the Uniform
Plumbing Code, 1976 edition adopted by this Chapter.
PART ONE
Administration
Section 20.1 - Administrative Authority
Is hereby amended to read:
Whenever the term "Administrative Authority" is used
in this Code it shall be construed to mean the Building
Official or his authorized representative.
Section 20.3 - Violation and Penalties
Paragraph one (1) is hereby amended to read:
Any person, firm or corporation violating any provision
of this Code shall be deemed guilty of a misdemeanor and,
upon conviction thereof, shall be punishable by a fine
not to exceed five hundred dollars ($500.00), or by
imprisonment in the County Jail for not to exceed six (6)
months, or both fine and imprisonment. Each separate day
or any portion thereof during which a violation of this
Code occurs or continues shall be deemed to constitute a
separate offense and, upon conviction thereof, shall be
punishable as herein provided. The isuance or granting
of a permit or approval of plans and specifications shall

not be deemed or construed to be a permit for, or an
approval of, any violation of any of the provisions of
this Code. No permit presuming to give authority to
violate or cancel the provisions of this Code shall be
valid, except insofar as the work or use which it
authorized is lawful.
Section 20.7 - Cost of Permit
Paragraph two (2) regarding Schedule of Fees is hereby
amended to read:
"Such applicant shall pay for each permit, at the time
of issuance, as per the latest resolution of the City
Council relating to the establishment of a Revised Fee
Schedule to be used with the latest edition of the
Uniform Plumbing Code.
Section 20.7A - Reinspection Fees
Section 20.7 is further amended by adding sub- paragraph A.
.;hen any reinspection is required because of the negligence
of the permit holder, his agent or other representative,
or because of the failure of such parties to comply with
previous correction instructions, a fee of $10.00 shall
be charged by the Administrative Authority for each
reinspection.
Section 20.7E - Refund of Plumbing Permit Fees
Section 20.7 is amended by adding sub - paragraph 13.
in the event that any person has obtained a permit here
under and no portion of the work or construction covered
by such permit has been commenced, such permittee shall
be entitled to a refund of 30% of the fee paid for such
permit in excess of $5.00 upon presentation of a written
request thereof.
Chapter 2, Section 203 Use of Copper Tubing
Shall be amended by adding sub - paragraph (F) to read as
follows:
(F) There shall be no fittings used with copper tubing
or pipe under slabs unless approved by the Administrative
Authority. (Refer to Section 1008 (c) 2)
Chapter 3, Section 316 hangers and Supports
Shall be amended by adding Item three (3) to subsection
(C) to read as follows:
(3) There shall be an insulating material between all
clamps tubing or pipe, to protect the pipe from damage
and allow free movement for expansion and contraction.

Chapter 9, Section 903 Overflows
Shall be amended by adding sub - paragraph (a) to read
as follows:
All openings in concrete floors, for both tub traps,
water closets, or any similar fixture shall have the
bottom and sides sealed off from the ground by not
less than one (1) inch of concrete, or other approved
material, leaving the trap free and this procedure may
be referred to and known as "Rodent Proofing ".
Chapter 10, Section 1009 (i) Size of Potable Water Piping
Shall be amended to read as follows:
(1) The Size of each branch or supply line shall be
determined by the number of fixture units to be served
by that branch, following the methods outlined in sub-
section (h) of this section. Each residential building
shall have a three quarter (3/4) inch diameter hose
bibb readily accessible to the front yard and a three
quarter (3/4) inch diameter hose bibb readily accessible
to the rear yard.
SECTION TV: Section 19 -3 - Uniform Swimming Pool Code
is Hereby added to and will become a part of this Ordinance.
Section 1.7 - Violations and Penalties
Is Hereby amended by adding the amount of fine and
length of time of imprisonment. The first sentence
to read as follows:
"Any person, firm or corporation violating any provision
of this Code shall be deemed guilty of a misdemeanor and
upon conviction thereof shall be nunisliable by a fine not
to exceed five hundred dollars ($500.00) or by imprisonment
in the County jail for not to exceed six (6) months, or
both fine and imprisonment."
The balance of this section remains the same.
Section 1.10 Application for Permit
Is hereby amended to add subsection D to read as follows:
(D) A presite inspection is required before a permit will
he issued and will include the following.
1. Verification of items listed under subsection A.
2. Condition of sidewalks, curbs, and gutters.
Section 1.11 Cost of Permits
Paragraph three (3) regarding Schedule of Fees is hereby
amended to read:

Schedule of Fees are deleted, as shown and will be
applicable as per the latest resolution of the City
Council relating to the establishment of a revised
Fee Schedule to be used with the latest edition of
the Uniform Plumbing Code.
Sections 401 through 421, of Chapter 4 Swimming Pool Heaters
and Vents
Is hereby cancelled and deleted from this Ordinance.
SECTION V: Section 19 -10 - Swimming Pools - Enclosures Required
No person shall maintain a swimming pool in the City unless he
shall at all times maintain on the lot or premises upon which
such pool is situated an enclosure as provided in this article.
Section 19 -11 - Specifications
The enclosure required by this article shall consist of a
wall, fence or other substantial structure not less than
five (5) feet in height above the highest grade adjacent
thereto and with no opening therein (other than doors or
gates) larger than three (3) inches in a perpendicular
plane with at least five (5) feet between any horizontal
members. The enclosure shall completely surround the
pool or the lot or premises upon which the pool is located.
Enclosures constructed after the effective date of this
article shall be constructed only of such materials as
will make them nonclimbable.
Section 19 -12 - Gates and Doors
All gates and doors opening through an enclosure required
by this article shall be equipped with a self- closing and
self- latching device designed to keep and capable of keeping
such gate or door securely closed at all times when not in
actual use; provided that the door of any dwelling House
forming any part of the enclosure need not be so equipped.
The latch shall be located a minimum of four (4) feet six
(6) inches above grade on the outside of the gate. The
gates and doors of any such enclosure need not be kept
locked or latched or closed during such time as the owner,
operator or any adult person is in active charge of the
swimming pool.
Section 19 -13 - Maintenance, Operation and Enforcement
Clarity of Water
Every owner of, and resident of, property on which there
is located a swimming pool, wading pool or other similar
body of water shall maintain the water therein in a suffi-
ciently clear and clean condition so that a black disc,
six (6) inches in diameter on a white field, when placed
at the bottom of such a body of water at its deepest point,
is clearly visible from the areas around the body of water
at all distances up to ten (10) yards from such a disc.

Cleanliness of Pool
Floating scum, sputum, and debris shall not be allowed
to accumulate in the pool. Skimmers, where provided,
and water levels shall be maintained and operated to
continuously remove such materials. The bottom and
sides of the pool shall be cleaned as often as necessary
to keep in a clean condition. The sides and bottom of
pools, decks and other surfaces shall be kept free of
slime and algae to prevent unnecessary slipperiness and
danger of accidents or drownings.
Enforcement
When a swimming pool becomes foul or stagnant through lack
of maintenance as described in the above sections, the
building official and /or health officer shall notify the
owner in writing to abate the hazard within forty -eight
(48) hours. Failure to comply within specified time shall
be a misdemeanor.
SECTION VI: Section 19 -20 - Uniform Solar Energy Code
Is hereby added to and will become a part of this Ordinance.
Section 20.3 - Violations and Penalties
Is hereby amended by adding the amount of fine and length
of time of imprisonment. The first sentence to read as
follows:
"Any person, firm or corporation violating any provision
of this Code shall be deemed guilty of a misdemeanor and
upon conviction thereof shall be punishable by a fine not
to exceed five hundred dollars ($500.00) or by imprisonment
in the County jail for not to exceed six (6) months, or
both fine and imprisonment."

or as per the latest resolution of the City Council relating
to the establishment of a revised fee schedule.
Section 20.6A - Reinspection Fees
Section 20.6 is further amended by adding sub - paragraph A.
When any reinspection is required because of the negligence
of the permit holder, his agent or other representative,
or because of the failure of such parties to comply with
previous correction instructions, a fee of $10.00 shall
by charged by the Administrative Authority for each
reinspection.

Section 20 -6B - Refund of Solar Energy Permit Fees
Section 20.6 is amended by adding sub - paragraph B.
In the event that any person has obtained a permit here
under and no portion of the work or construction covered
by such permit has been commenced, such permittee shall
be entitled to a refund of 80% of the fee paid for such
permit in excess of $5.00 upon presentation of a written
request thereof.
SECTION VII: Severabilty
If any section, subsection, sentence, clause phrase or portion
of this Ordinance is for any reason held to be invalid or un-
constitutional by the decision of any court of competent juris-
diction, such decision shall not affect the validity of the
remaining portions of this Ordinance. The City Council of the
City of Cypress hereby declares that it would have adopted this
Ordinance and each section, subsection, sentence, clause phrase
or portions be declared invalid or unconstitutional.
PASSED AND ADOPTED by the City Council of the City of Cypress, at
a regular meeting held on the 8th day of May , 1978.
