Ordinance No. 618ORDINANCE NO. 618 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS ADDING ARTICLE X, "CAMPAIGN REFORM" TO THE CITY CODE OF THE CITY OF CYPRESS, PLACING A LIMITATION ON THE MAXIMUM AMOUNT OF CAMPAIGN CONTRIBUTIONS IN ANY SINGLE MUNICIPAL ELECTION. THE CITY COUNCIL OF THE CITY OF CYPRESS DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Intent and Purpose It is the intent of the City Council of the City of Cypress in enacting this Ordinance to place reasonable limits upon campaign con- tributions in municipal elections to assure that the amount of money contributed by any person does not materially influence the outcome of any election. The City Council finds, in this regard, that muni- cipal elections constitute municipal affairs, and that the reasonable regulation thereof as herein set forth is within the jurisdiction of the charter City of the City of Cypress. SECTION 2. The City Council of the City of Cypress does hereby add Article X to Chapter 2 of the City Code to read as follows: Chapter 2 Administration Article X. Campaign Reform Sec. 2 -95. Campaign Contributions - Limitations (a) No person shall make to or solicit or accept from any other person, any contribution, gift, subscription, loan, advance, deposit, pledge, promise of money, or any other thing of value in excess of One Hundred Dollars ($100) in aid or support of the election or defeat of any single candidate in any single election for any municipal office during the calendar year of, prior to, or subsequent to the year in which the election is held. (b) No person shall make to or solicit or accept from any other person, any contribution, gift, subscription, loan, advance, deposit, pledge, promise of money, or any other thing of value in excess of One Hundred Dollars ($100) in aid or support of the passage or defeat of any municipal ballot measure or proposition in any single election during the calendar year of, prior to, or subsequent to the year in which the election is held. (c) "Person" means an individual, proprietorship, firm, partnership, joint venture, syndicate, business, trust, company, corporation, association, committee, or any other organization or group of persons acting in concert. Provided, however, that nothing contained herein shall prohibit a campaign committee acting merely as a conduit for making, soliciting or accepting contributions from or to other persons. (d) Nothing in this Ordinance shall be interpreted to prohibit a candidate from contributing to his /her own election in amounts greater than the amounts stated herein. Sec. 2 -96. Relation to Political Reform Act of 1974 This Article is intended to be a supplement to and not in conflict with the Political Reform Act of 1974. Unless otherwise defined in this Ordinance, words and phrases shall have the same meaning herein as when they are used in Title 9 of the California Government Code, in which the Political Reform Act of 1974 is codified. Sec. 2 -97. Violation. Any person violating any of the provisions of this Article shall be guilty of a misdemeanor and shall be punishable by a fine not to exceed Five Hundred Dollars ($500) or imprisonment in the County Jail for a period not to exceed six months, or by both fine and imprisonment.
