Ordinance No. 459ORDINANCE N0. 459 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS AMENDING SECTIONS 107.2, 108.2, 109.2, 110.2, AND 116.2 OF ORDINANCE NO. 90, AS AMENDED, PROHIBITING THE OPERATION OF CERTAIN VEHICLES IN THE RESIDENTIAL AND PLANNED MANUFACTURING ZONES. THE CITY COUNCIL OF THE CITY OF CYPRESS DOES ORDAIN AS FOLLOWS: SECTION 1: Section 107.2 of Ordinance No. 90, as amended, is amended to read: Only the following buildings, structures and uses are permitted in the R -1 zone. No buildings, or structures shall be erected, structurally altered or enlarged, or land used, except for the following purposes: A. One- family dwelling unit. Only one per lot. B. Home occupations. C. Swimming pools. The operation of any motorcycle, motor- driven cycle, mini -bike, trail - bike, motor scooter, jeep, dune buggy or other similar self- propelled vehicle, except on public streets and except also for purposes of direct ingress and egress from public streets to improved off - street parking areas, is expressly prohibited. SECTION 2: Section 108.2 of Ordinance No. 90, as amended, is amended to read: read: Only the following buildings, structures, and uses are permitted in an R -2 zone. No buildings or structures, shall be erected, structurally altered, or enlarged, or land used, except for the following purposes: A. Any use permitted in the R -1, One - family Residential Zone, subject to the regulations and restrictions of said zone, except that the R -2 building setback provisions shall govern the building setback line, B. Two - family dwelling units either in separate buildings or com- bined in one or two main buildings. C. More than two - family dwelling units and not exceeding four - family dwelling units either in separate buildings or combined in two or more main buildings, subject to obtaining a conditional use permit. The operation of any motorcycle, motor - driven cycle, mini -bike, trailbike, motor scooter, jeep, dune buggy or other similar self- propelled vehicle, except on public streets and except also for purposes of direct ingress and egress from public streets to improved off - street parking areas, is expressly prohibited. SECTION 3: Section 109.2 of Ordinance No. 90, as amended, is amended to Only the following buildings, structures, and uses are permitted in the R -3 zone. No buildings or structures shall be erected, structurally altered or enlarged, or land used, except for the following purposes: A. Churches - subject to the issuance of a Conditional Use Permit by the City Council. B. Convalescent or Rest Homes - subject to the issuance of a Con- ditional Use Permit by the City Council. C. Multiple - family dwelling or apartment house - subject to the issuance of a Conditional Use Permit by the City Council. 1 read: read: D. Condominiums and similar types of development - subject to the issuance of a Conditional Use Permit by the City Council and subject to conditions set out in Section 109.10. The operation of any motorcycle, motor - driven cycle, mini -bike, trailbike, motor scooter, jeep, dune buggy, or other similar self - propelled vehicle, except on public streets and except also for purposes of direct ingress and egress from public streets to improved off - street parking areas, is expressly prohibited. SECTION 4: Section 110.2 of Ordinance No. 90, as amended, is amended to Only the following buildings, structures, and uses are permitted in the R -4 zone. No buildings or structures shall be erected, structurally altered or enlarged, or land used, except for the following purposes: A. Churches - subject to a Conditional Use Permit. B. Convalescent or Rest Homes - subject to a Conditional Use Permit. C. Multiple family dwellings or apartment houses consisting of a single structure which contains not more than ten (10) dwelling units. D. Multiple family dwellings or apartment houses consisting of more than one structure or in one structure which contains more than ten (10) dwelling units - subject to obtaining a Conditional Use Permit, E. Day Nurseries - subject to obtaining a Conditional Use Permit. F. Private, non - profit, recreational facilities, subject to obtaining a Conditional Use Permit, G. Mobilehome Courts, minimum area seven (7) acres, subject to obtaining a Conditional Use Permit. H. Condominiums and similar types of development,subject to obtaining a Conditional Use Permit. I. Rooming and boarding houses and foster homes for any number of guests, subject to obtaining a Conditional Use Permit, The operation of any motorcycle, motor- driven cycle, mini -bike, trailbike, motor scooter, jeep, dune buggy or other similar self- propelled vehicle, except on public streets and except also for purposes of direct ingress and egress from public streets to improved off - street parking areas, is expressly prohibited. SECTION 5: Section 116,2 of Ordinance No. 90, as amended, is amended to Only the following buildings, structures and uses either singly or in combination, and those uses qualifying for and obtaining a conditional use permit, are permitted in a PM, Planned Manufacturing Zone, provided they comply with the performance standards set out herein. No building or structure shall be erected, structurally altered, or enlarged, or land used, except for such purposes; namely: A. Administrative and professional offices, accessory to uses permitted in this district. B. Residence for watchmen or custodians employed on site. C. Cafeterias or auditoriums accessory to the permitted use. D. Chemical laboratories, research laboratories and institutes. - 2 - E. Electrical, electro- mechanical and electronic products and in- struments manufacturing. F. Cartography, bookbinding, printing and lithography. G. Fabrication of plastic and finished paper products. H. Research and development, I. Laboratories. J. Storage warehouses, excluding inflammable materials. K. Precision machine shops, editorial and designing, prototype production and fabrication of components. L. Furniture upholstering, furniture manufacturing, finished paper products. M. Assembling and construction of paper products with finished paper stock; garment manufacturing; laundry and drycleaning plants. N. Manufacture of novelties, toys and small appliances. 0. Public utility uses. P. Wholesale stores and storage. Maintenance and operation of all uses shall be subject to the provisions of the performance standards set out herein. The operation of any motorcycle, motor - driven cycle, mini -bike, trailbike, motor scooter, jeep, dune buggy or other similar self- propelled vehicle, except on public streets and except also for purposes of direct ingress and egress from public streets to improved off - street parking areas, is expressly prohibited. SECTION 6: This Ordinance is declared to be an urgency measure necessary for the immediate preservation of the public peace, health, and safety and shall become effective on this date, The facts constituting the emergency are as follows: There has been a recent and sudden increase in the ownership and operation of vehicles capable of being operated off of the public roads, The operation of these vehicles generates excessive amounts of irritating dust, noxious exhaust fumes, and noise. Such operations also create a high risk of igniting brush and grass fires and of the destruction of natural ground cover which will result in dangerous erosion of land, all of which constitutes a nuisance and a danger to persons and property within the City of Cypress. Said situation is presently aggrevated by the summer season in which warm weather and long hours of daylight have increased the incidents of such vehicular use and have increased the nuisance since the residents of the City of Cypress tend to leave their windows open more often and to spend more time out of doors during this time of year. SECTION 7: This Ordinance shall remain in effect through September 13, 1971 and shall thereafter expire unless renewed prior thereto.
