AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS
AMENDING SECTIONS 5 -1 AND 5 -2 OF CHAPTER 5 AND DELETING SECTIONS
11 -1 IhROUGH 11 -23 OF CHAPTER 11 OF THE CYPRESS CITY CODE, THEREBY
ADOPTING BY REFERENCE THE FOLLOWING 1973 EDITIONS OF THE UNIFORM
BUILDING CODES: UNIFORM BUILDING CODE, UNIFORM MECHANICAL CODE,
UNT ORM HOUSING CODE, UNIFORM CODE FOR THE ABATE IT OF DANGEROUS
BUILDINGS, UNIFORM FIRE CODE, AND UNIFORM BUILDING CODE STANDARDS.
THE CITY COUNCIL OF THE CITY OF CYPRESS DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1: Sections 11 -1 - 11 -23 of the Cypress City Code are hereby
repealed.
SECTION 2: Section 5 -1 of Chapter 5 of the Cypress City Code hereby
to read as follows:
SECTION 5 -1 Uniform Building Codes - Adopted; where filed.
The following hereby are adopted by reference, as amended by
Section 5 -2 of this Chapter, as the Building Codes of the City of
Cypress, three (3) copies of each which are on file in the off;
of the City Clerk:
a. "Uniform Building Code ", 1973 Edition, and appendices,
except Section 205 thereof;
b. "Uniform Mechanical Code ", 1973 Edition, except Section
202 thereof;
c. "Uniform Code for the Abatement of Dangerous Buildings ",
1973 Edition;
d. "Uniform Housing Code ", 1973 Edition;
e. "Uniform Building Code Standards", 1973 Edition; and
f. "Uniform Fire Code ", 1973 Edition.
SECTION 3: Section 5 -2 of Chapter 5 of the Cypress City Code hereby
is amended to read as follows:
Uniform Code - Amendments, additions and deletions.
u. the following amendments are made to the Uniform Building
Code, 1973 Edition, adopted by this Chapter:
1. Section 205 is amended to read as follows:
"It shall be unlawful for any person, firm, or corporation to
erect, construct, enlarge, alter, repair, move, improve, remove,
convert, or demolish, equip, use, occupy, or maintain any build-
ing or structure in the City, or cause the same to be done, con-
trary to or in violation of any of the provisions of this Code.
Any person, firm, or corporation violating any of the provisions
of this Code shall be deemed guilty of a misdemeanor, and each
such person shall be deemed guilty of a separate offense for each
and every day or portion thereof during which any violation of any
of the provisions of this Code is committed, continued, or permit-
ted, and upon conviction of any such violation, such person shall
be punishable by a fine of not more than Five Hundred Do11ars
($500.00), or by imprisonment for not more than six (6) months, or
by both such fine and imprisonment."
2. Section 303 is amended by adding the following:
"(e) Refund of Building Permit Fees.
In the event that any person has obtained a building permit
and no portion of the work or construction covered by such
permit has been commenced, and such permit has not expired,
or been suspended or revoked, as provided in Section 302 (d)
or Section 302 (e) of the Code, the permittee shall be en-
titled to a refund of eighty percent (80%) of the fee paid
for such permit, upon presentation to the Building Superin-
tendent of a written request therefor."
3. Section 303 (d) is amended by adding the following:
"(d) Reinspection Fees.
When any reinspection is required because of the negligence
of the permit holder, his agent, or other representative,
or because of the failure of such parties to comply with
previous correction instructions, a tee as set forth in
Section 303 (d) shall be charged by the Building Official
for each such reinspection."
4. Section 1711 (d) is hereby amended by adding the following:
"(d) All Shower Areas.
Shower stalls and the bathtub enclosures used as shower
stalls shall be plastered with Portland Cement Plaster
as required for the first two coats of exterior work.
Such plaster shall be carried to a height of not less
than six feet (6') above the drain outlet and across the
full width of the door .jam. In the case of tub enclosures,
said plaster shall be c3.rried at least four inches (4 ")
beyond the outer edge of the tub. Metal reinforcement
and backing shall be as required fox exterior plastering
in Chapter 47.
EXCEPTION: This Section shall not apply to approved
prefabricated shower enclosures."
5. Section 1718 is hereby added to read as follows:
Building Insulation
(a) General. All hotels, motels, apartment houses, lodging houses,
dwellings and other residential buildings which are heated or
cooled mechanically shall be constructed to comply with the
maximum "U" value contained in Tables Nos. 17 -B through 17 -E.
A building which is both heated and cooled shall be insulated
against the most severe climatic condition for the location and
type of structure involved.
(b) Ceilings and Walls in Heated Buildings. For ceilings and wall
sections in heated structures only, the thermal transmittance
shall be no more than the values shown in Table No. 17 -B.
Note. Where more than 25 percent of the exposed exterior wall
is glass. at least one - fourth of all glass surfaces shall be
insulating glass or storm sash in areas with degree days ranging
between 4500 and 5200. Where the degree days range between
5201 and 6000, at least 50 percent of all glass surfaces shall
be insulating glass or storm sash. All glass surfaces in struc-
tures located in areas where degree days exceed 6000 shall be
insulating glass or storm sash.

(c) Ceilings and Walls in Mechanically Cooled Buildings. Ceilings
and wall sections which are in heated or mechanically cooled
buildings shall have a thermal transmittance not more than the
values shown in Table No. 17-C.
(d) Floor Sections, Foundation Walls and Slabs -on- Grade. For floors
over unheated basement, unheated garages or ventilated crawl
spaces with operable louvers, the "tU" values of floor section
shall not exceed the value shown in Table No. 17 -D.
Insulation may be omitted from floors over heated basement areas,
or heated crawl spaces, if foundation walls are insulated. Foun-
dation walls of heated basements need not be insulated except
where habitable rooms are provided. The "U" value of foundation
wall sections shall not exceed the value shown in Table No. 17 -E.
For slab -on- ground floors the edge heat loss around the perimeter
of heated spaces shall not exceed a maximum value per linear
foot of exposed edge of 42 B.t.u.h. for heated slabs. Calculations
of heat loss around slab edges shall be made using the following
formula:
H = F X P
WHERE:
H = Heat loss of the slab edge in B.t.u.h.
F = Heat loss coefficient from Table No. 17 -F in B.t.u.h.
per linear foot of exposed edge.
P = Perimeter or exposed slab edge (linear feet).
(e) Loose Fill. Blowing and poured type loose fill may be used in
attic spaces where the slope of the roof is not less than 21
feet in 12 feet and there is at least 30 inches of clear headroom
at the roof ridge. ( "Clear Headroom" is defined as the distance
from the top of the bottom chord of the truss or ceiling joists
to the underside of the roof sheathing.) When eave vents are
installed, adequate baffling of the vent opening must be provided
so as to deflect the incoming air above the surface of the installed
blown or poured insulation. Baffles shall be made of wood or
other durable material and shall be installed at the soffit on a
60- degree angle. Baffles shall be in place at the time of framing
inspection. When loose fill insulation is proposed, the R value of
the material shall be shown on the building plans, together with
the total number of bags and net coverage per bag.
(f) Design Temperature. Inside winter design temperature shall be
not less than 70 °F. and Summer Design Temperature not greater
than 75 °F. Heat loss and heat gain calculations shall be made
using the winter design dry bulb at 99 percent ind summer design,
dry bulb at 1 percent shown in the current ASHRAE Handbook of
Fundamentals.
b. The following amendments are made to the "Uniform Mechani-
cal Code ", 1973 Edition, adopted by this Chapter:
Chapter 5 is hereby amended by adding thereto the following
section:
"Section 511. Prohibited Locations.
Equipment regulated by this Code shall not be located
in any required front or side yard as established by
the Building Code or Zoning Ordinances."
c. The following amendments are made to the "Uniform Housing
Code ", 1973 Edition, adopted by this Chapter:
Chapter 2 is hereby amended by adding thereto the following
sections:
1. "Section H -201 (a). Authority.
The Building Official and the Health Officer are
hereby authorized and directed to administer and
enforce all of the provisions of this code."
2. "Section H -201 (b). Right of Entry.
Whenever necessary to make an inspection to enforce
any of the provisions of this code, or whenever the
Building Official, the Health Officer, or their auth-
orized representatives have reasonable cause to believe
that there exists in any building or upon any premises,
any condition which makes such building or premises sub-
standard as defined in Section H -202 of this Code, the
Building Official, the Health Officer, or their autho-
rized representatives may enter such building or pre-
mises at all reasonable times to inspect the same or to
perform any duty imposed upon the Building Official or
the Health Officer by this code; provided that if such
building or premise, be occupied, they shall first pre-
sent proper credentials and dernnid entry; and if such
building or premise:; be unoccupied, they shall first
make a reasonable effort to locate the owner or other
persons having charge or control of the building or
premises and demand entry. If such entry is refused,
the Building Official, the Health Officer or their
authorized representatives shali have recourse to
every remedy provided by law to secure entry.
No owner or occupant or any other person having
charge, care or control of any building or pre-
mises shall fail or neglect, after proper demand is
made as herein provided, to properly permit entry
therein by the Building Official, the Health Officer
or their authorized representatives for the purpose
of inspection and examination pursuant to this code.
Any person violating this subdivision shall be guilty
of a misdemeanor."
d. The following amendments are made to the "Uniform Fire Code ",
1973 Edition, adopted by this Chapter:
1. Section 1.216 is hereby amended to read as follows:
"Section 1.216. Whenever this Code is inapplicable
for any reason to any situation involving the pro-
tection of persons and property from the hazards of
fire and explosion, the materials, methods of con-
struction, installations, practices, or operations
necessary to provide such protections shall, to a
reasonable degree, be in accordance with nationally
recognized and accepted standards, principles and
tests generally recognized and well established
methods of•fire prevention and control, as set forth
in the following publications by recognized national
authorities and technical or scientific organizations,
which are adopted by reference as part of this Code
as though set forth herein in full.

2. Section 1.403 is hereby amended to add the following
definition thereto:
"AUTHORIZED REPRESENTATIVE shall mean those per-
sons described in Sections 1.204, 1.205 and
1.206 of this Code."
3. Article 10 is hereby amended to add Section
10.114 as follows:
"MALLS.
Section 10.114
(a) General. Every mall shall be provided with exits
directly to the exterior as required by the Uniform
Building (odP.
(b) The clear and unobstructed exit width on each side of
the mall shall be as required by the Uniform Building
Code but in no case shall be less than ten feet (10')
wide. The clear area shall be defined, identified and
maintained in a manner approved by the Chief.
(c) No display, side show, exhibition or promotional
activity or similar use shall be permitted in the
center area of the mall unless there is first ob-
tained from the Chief a permit to conduct such
activity. Included with each permit application
shall be a floor plan delineating the exact area
to be used and showing the location of all dis-
plays.
(d) All of the conditions of Article 26 of this Code
shall be applicable when the mall is used for other
than, and, or in addition to an exit corridor.
(e) Not more than thirty feet (30'? between ten foot
(10') wide cross - aisles shall Fe permitted except
as required or permitted by the Chief.
(f) All flammable material used as, or in conjunction
with, a display, side show, exhibition, promotional
activity or similar use which would tend to increase
the fire or panic hazard shall be maintained in a
flame retardant condition or similarly protected
in a manner approved by the Chief.
(g) No use shall be permitted which by its nature
will impede free and unobstructed exiting due to
people congregating to witness or participate in
the display, side show, exhibition, promotional
activity or similar use.
(h) The use of flammable liquid, liquified petroleum
gas, flammable bottled gases and other materials
presenting an unusual fire hazard shall not be
permitted as a part of, or in conjunction with,
any mall display, side show, exhibition, promotional
activity or other similar use.
(i) All automatic fire sprinkler systems shall be
provided with approved alarm and valve super-
vision."
4. Subparagraph (b) of Section 12.102 is hereby amended to
read as follows:
"(b) The sale of Safe and Sane Fireworks (as defined by
Section 12504 of California Health and Safety Code)
shall be permitted only under the following condi-
tions:
1. No fireworks shall be sold before 12:00 noon, June
28, or after 10:00 p.m., July 4, or at all unless
a permit to do so is first obtained as provided
herein. The hours of operation shall be 9:00 a.m. -
10:00 p.m.
2. No application for a permit will be considered or
granted which is not accompanied by a license
issued by the State Fire Marshal of California.
3. The violation of any law pertaining to the sale of
fireworks shall automatically render this permit
void.

4. No person shall sell, or offer for sale or discharge
any fireworks within a distance of 100 feet of any pump
or dispensing device for flammable liquids nor within
fifty feet (50') of any structure or tent.
5. At least one (1) approved water -type fire extinguisher
must be provided for every twenty feet (20') of stand
frontage.
6. Temporary stands shall be constructed of materials
equal to twenty -eight (28) gauge sheet metal or three -
eight's inch (3/8 ") exterior plywood. A minimum of
two (2), thirty inch (30 ") exits shall be provided
and are to remain open during hours of sale.
7. No permit shall be issued for the sale of fireworks
from a temporary fireworks stand unless the applicant
shall file an application therefore on a form approved
by the City of Cypress together with a cash bond in
the sum of Fifty Dollars ($50.00) in a form acceptable
to the City of Cypress, the condition of which shall
be as follows: That the fireworks stand be removed
and the premises upon which it was located cleaned
of all debris of every description and the premises
restored to the condition they were in prior to the
erection of the fireworks stand by July llth of the
year for which such permit was issued. If the work
of removal of the fireworks stand and cleaning the
premises be not completed within the time herein
provided, then and in that event, the cash bond
shall be deemed to the summarily forfeited in its
entirety, and the City of Cypress shall perform the
work of removing the fireworks stand and cleaning
the premises.
8. No application for a permit for the sale of fire-
works at a fireworks stand shall be considered or
granted which is not accompanied by the written
consent of the owner of the premises upon which
the fireworks stand is proposed to be located con-
senting to the entry upon the premises by the City
for the purpose of removing the fireworks stand
and cleaning the premises in case the permittee
shall default therein.
9. No fireworks stand shall be located closer than
five feet (5') to the right -of -way line of any
public road or highway, or at any location which
does not otherwise meet with the approval of the
Chief.
10. No signs shall be erected or maintained in con-
nection with a fireworks stand which shall create
a traffic hazard.
11. Storage of fireworks shall be in the fireworks
stand or at locations approved by the Chief. Fire-
works stands used for storage shall be under twenty -
four (24) hour supervision of an alert adult. No
sleeping inside of fireworks stands shall be per-
mitted at any time.
12. "No Smoking" signs shall be posted in an easily
visible location on all sides of fireworks stand.
No smoking shall be permitted within fifty feet
(50') of any fireworks stand.
13. No permit will be issued for the sale of fire-
works at a temporary fireworks stand except in
Zones CO, CN, CG, or CH as the same are estab-
lished by the zoning ordinance for the City of
Cypress.
14. No person shall alloy any rubbish to accumulate
in or within fifty feet (50') where any fire-
works are stored or sold.
15. At least one (1) person eighteen (18) years of
age or older shall be in attendance at all
times. No person less than sixteen (16) years
of age shall be permitted inside the stand.
16. Any fireworks stand that is to be energized
will require an electrical permit from the
Department of Building and Safety.
17. Each application for a permit required by
Section 12.102 (b) shall be accompanied with
a certificate from an insurer authorized to
insure risks within the state, to the effect
that the applicant has in effect, for the
period on or beginning on the date the appli-
cation was filed and ending on July 31 for
the year for which the application was filed,
public liability insurance in the amount as
required by the city attorney. Such insurance
is required of any applicant for a permit
under this section. Should any of the insurance
required by this section expire, terminate or
be cancelled on or before July 31 of the year
for which the application is filed and the
permit is issued, the applicant or permittee
shall notify the city clerk of that fact, and,
whether or not such notice is given, no permit
shall be valid after any such insurance has expired,
terminated or been cancelled."
5. Section 13.208 is hereby amended to read as follows:
"ACCESSWAY FOR FIRE APPARATUS.
Sec. 13.208. All premises on which a building
is hereafter constructed and located shall be provided,
as may be required by the Chief, with an accessway to
any such building thereon. Such accessway shall have
sufficient horizontal and vertical clearance and shall
be constructed and maintained to accommodate fire
apparatus.,
EXCEPTION: Group I and J occupanices as specified
in the Building Code.
Where auxilary means of access or fire protective
measures, approved by the Chief, are provided, the above
required clearance may be modified or waived."
6. Subparagraphs (b) and (c) of Section 13.30]. are hereby
emended to rP.P.d as follows:
"Section 13.301

(b) In occupancies of an especially hazardous nature,
or where special hazards exist in addition to the
normal hazard of the occupancy, or where access
for fire apparatus is unduly difficult, additional
safeguards may be required, consisting of additional
fire appliance units, more than one type of appli-
ance or special systems suitable for the protection
of the hazard involved. Such devices or appliances
may consist of fire hydrants, automatic fire alarm
systems, automatic sprinkler or water spray systems,
standpipe and hose, fixed or portable fire extin-
guishers, suitable asbestos blankets, breathing
apparatus, manual or automatic covers, or carbon
dioxide, foam or other special fire extinguishing
systems. Where such systems are installed, they
shall be in accordance with this applicable standards
of the National Fire Protection Association.
(c) All premises where buildings or portions of build-
ings are hereafter constructed shall be provided,
as may be required by the Chief, with street fire
hydrants and water mains capable of supplying the
fire flow required by the Chief.
7. Subparagraphs (d), (e) and (f) are hereby added to Section
13.301 as follows:
"(d) All premises where buildings or portions of buildings
other than dwellings are hereafter constructed and
located more than one hundred fifty feet (150') from the
public street providing access to such premises shall
be provided, as may be required by the Chief, with
on -site approved fire hydrants connected to a water
system capable of supplying the fire flow required by
the Chief. The type and location of such hydrants
shall be as designated by the Chief. Paved access
to fire hydrants shall be provided and maintained to
accommodate fire - fighting apparatus.
(e) All premises where dwellings or portions of dwellings
are hereafter constructed shall be provided with street
fire hydrants as may be required by the Chief. The
type and location of such fire hydrants shall be as
designated by the Chief.
(f) All required fire hydrants are to be of an approved
type, wet or dry barrel, with a six inch (6 ") branch
connection to the main, a six inch (6 ") valve on the
branch connection, a four inch (4 ") pumper outlet
and 1 or 2 two and one -half inch (21 ") outlets."
8. Exception No. 1 to Section 13.311 is hereby amended to read
as follows:
"EXCEPTIONS:
1. Wet standpipes are not required in buildings equipped
with a complete automatic fire extinguishing system,
except, however, wet standpipes are required in all
buildings used, all or partially, for the storage
of high piled combustible stock."
9. Article 13 is hereby amended to add Section 13.315 as follows:
"COOKING EQUIPMENT.
Sec. 13.315
7.
(a) General. All occupancies containing cooking equipment
in commercial, industrial, institutional, and similar
cooking applications other than installations for
residential family use shall:
1. Have hoods, ducts, and grease removal equip-
ment installed in conformance.with NFPA Stand-
ard No. 96, 1971 Edition.
2. Have installed and shall maintain an automatic
fire extinguishing system approved by the Chief,
where:
(i) The occupant load exceeds 50 people
(ii) The hood or plenum area exceeds 10
square feet, or
(iii) A deep fat fryer exceeds 144 square
inches, or
(iv) A grill or broiler exceeds 248 square
inches.
(b) Installation of automatic fire extinguishing systems
for the protection of hood and duct ventilation systems
and related commercial cooking appliances.
1. The system shall be listed and approved by a
nationally recognized testing agency.
EXCEPTION: Industrial cooking appliance systems
shall be engineered by the manufacturer in ac-
cordance with nationally recognized standards
and installed according to their instructions.
2. The system shall be designed and installed in
accordance with the instructions of the manu-
facturer as approved by the testing agency
and in accordance with current NFPA Standards
Numbers 10, 11, 12, 13, 15, 16, 17, and 96.
The local fire authority having jurisdiction
may approved modifications.
3. The system shall be installed by a licensed
contractor who has been certified by the
manufacturer.
4. The system shall provide protection for duct
systems, grease removal devices, and hoods.
Cooking equipment which may be a source of
ignition of grease in the hood, grease removal
device or duct (such as, fat fryers, ranges,
griddles, and broilers) shall also be protec-
ted by approved extinguishing equipment. If
acceptable to the authority having jurisdic-
tion, that portion of the fire extinguishing
system required for protection of the duct
may be omitted when all cooking equipment
is served by an approved grease extractor.
5. A readily accessible means to manually ac-
tuate the system shall be provided and
clearly identified. Such means shall not be
more than six feet (6') in height and shall
be a reasonable distance from the area pro-
tected and within an exit path.

6. All fixed piped systems, except sprinkler systems,
within a single hazard area, shall be arranged for
simultaneous automatic operation upon actuation of
any one system.
7. The operation or a system shall automatically shut
off the fuel or heat supply to all cooking devices
protected by the system. A manual operation shall
by required to reestablish the fuel or heat supply.
This operation shall not be possible until the
system is recharged. When gaseous fuels are used,
a permanent notice shall be posted at the reset
device cautioning the operator to shut off the
gas at all appliances before resetting the device.
Electrically heated :quipment otner than fat fryers
and broilers need not be shut off.
8. Visual means shall be provided to show the system
is energized if actuation is electrical.
9. Prior to installation, notification shall be made
to the local fire authority.
10. Working plans ana specifications shall be submitted
to the local tire authority for review and approval
prior to installation. The plans shall include:
(i) Diagram of area and equipment to be pro-
tected including the dimensions of the
hood and duct and all surfaces and ap-
pliances.
(ii) Manufacturer and model number of system
or systems proposed.
(iii) Diagram of system piping and all component
parts.
(iv) Size and length ot piping and pipe schedule.
(v) Size and number of elbows and tees.
(vi) Model numbers and location of nozzles.
(vii) Location and temperature ot fusible links.
(viii) Location of system cannister.
(ix) Location and identity of any auxiliary
equipment, including gas and power (elec-
tric) shut offs.
11. At least one current manufacturers installation manual
shall be provided to the local fire authority for each
system installed.
12. Where field conditions necessitate change from the
approved plans, the prior approval of the local fire
authority shall be required.
13. A final inspection of the installed system shall be
made by the local fire authority, which shall include
witnessing of a test of the automatic and manual
operating devices.

14. The local fire authority shall be notified twenty -
four (24) hours prior to the test.
15. Extinguishing systems shall be inspected at intervals
required by the local fire authority, but in no case
less than once each twelve (12) months.
16. A copy of the Certificate of Inspection signed by the
inspector, approved by the local fire authority, shall
be forwarded to the local fire authority within twenty -
four (24) hours after inspection or servicing."
10. Subparagraph (f) of Section 15.102 is hereby amended to read
as follows:
"(f) The flash point of liquids having a flash point at or
below 175 °F. (79 °C.) except for fuel oils and certain
viscous materials, shall be determined in accordance
with the Standard Method of Test for Flash Point by
the Tag Closed Tester, ASTM D56 -70.
The flash point of fuel oil, and certain viscous
materials having a flash point at or below 175 °F.,
shall be determined in accordance with the. Standard
Method of Test for Flash Point by the Pensky - Martens
Closed Tester, ASTM D93 -71."
11. Subparagraph (g) is hereby added to Section 15.102 as follows:
„(8)
SWING JOINT shall mean any one of the following:
1. Extractor type foot valve housing with either a
street elbow or a nipple and an elbow.
2. An elbow and a street elbow.
3. Two elbows and a nipple not over 6" long. (NOTE:
Due to structural weakness, a "close" nipple shall
not be permitted)."
12. Subparagraph (b) 4(i) is hereby amended to read as follows:
"(i) ,In rooms or areas accessible to the public, storage
shall be limited to quantities needed for display
and normal merchandising purposes but shall not exceed
the following amounts of flammable liquids in sprinklered
buildings:
(a) 60 gallons of Class 1 -A
(b) 120 gallons of Class 1 -B
(c) 180 gallons of Class 1 -C
(d) 240 gallons of Class II
(e) 240 gallons of Class III
(f) A total of 480 gallons for any combination
of these, or
(g) 2 gallons per square foot gross floor area.
The gross floor area used for computing the maximum
quantity permitted shall be considered as that por-
tion of the store actually heing used for merchan-
dising flammable and combustible liquids.
In unsprinklered buildings, only two- thirds (2/3)
of these amounts shall be allowed."

13. Subparagraph (b)5 is hereby added to Section 15402 as
follows:
"5. General Purpose Warehouses. Storage shall be in
accordance with Table 15.402 and shall be non-
combustible or fire resistive buildings or in por-
tions of such buildings cut off by standard fire
walls as set forth in the Uniform Building Code.
Materials creating no hazard to the liquids may be
stored in the same area."
14. Article 30 is hereby amended to add Section 30.121 to read
as follows:
"SPECIAL REQUIREMENTS FOR AIR SUPPORTED STRUCTURES.
Sec. 30.121. Air supported structures used for
assembly purposes as defined in Sec. 30.102 shall be
provided with poles, stanchions, cables or similar
equipment which will prevent collapse of the structure
upon those assembled therein."
SECTION 4: Severability.
If any section, subsection, sentence, clause, phrase or portion of
this Ordinance is for any reason held to be invalid or unconstitutional
by the decision of any court of competent jurisdiction, such decision shall
not affect the validity of the remaining portions of this Ordinance. The
City Council of the City of Cypress hereby declares that it would have
adopted this Ordinance and each section, subsection, sentence, clause, phrase
or portion thereof, irrespective of the fact that any one or more sections,
subsections, clauses, phrases, or portions be declared invalid or unconsti-
tutional.
SECTION 5: Declaration of Facts Constituting Urgency.
This ordinance is an urgency ordinance required for the immediate preser-
vation of the public peace, health and safety and shall take effect immediately
upon adoption. The following are the facts constituting the urgency:
In recent months, it has become apparent that this country's
energy reserves have reached a dangerously low state and that unless
immediate steps are taken to conserve our energy resources until
these reserves can be replenished or alternative sources of energy
established, severe shortages will occur. This ordinance provides
for the installation of energy conserving insulation in new hotels,
motels, apartment houses, homes and other residential dwellings and
establishes standards of energy insulation necessary to conserve our
fuel resources.
PASSED AND ADOPTED by the City Council of the City of Cypress at a regular
meeting held on the llth day of March, 1974.
