Ordinance No. 544sir a ogg 4_ i tJ ORDINANCE NO. 544 AN INTERIM URGENCY ORDINANCE OF THE CITY OF CYPRESS AMENDING SECTION 10.1 OF ORDINANCE NO. 497, THE ZONING ORDINANCE OF THE CITY OF CYPRESS, TO DELETE ARTIST AND PHOTOGRAPHIC STUDIOS AS PERMITTED USES IN THE CH ZONE. THE CITY COUNCIL OF THE CITY OF CYPRESS DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Section 10.1 of Ordinance No. 497, the Zoning Ordinance of the City of Cypress, hereby is amended to delete as permitted uses in the CH Commercial Highway Zone artist and photographic studios. SECTION 2. This Ordinance is adopted pursuant to the provisions of Section 65858 of the Government Code of the State of California in order to protect the public safety, health, and general welfare; and it shall take effect immediately. SECTION 3. The City Council finds and determines that the Planning Department is considering a zoning proposal pursuant to which artist and photographic studios would be prohibited in the Commercial Highway Zone. This Ordinance is therefore necessary in order to prevent any uses which might be in conflict with said zoning proposal. SECTION 4. The City Council further finds and determines that the following facts constitute the urgency requiring this Ordinance to take effect immediately: The Commercial Highway Zone is intended to provide appropriately located areas for establishments catering primarily to highway travelers, visitors to the City, and such businesses or uses where direct access to major arterial highways is essential or desirable for their operation. Artist and photographic studios are not such uses as are contemplated for the Commercial Highway Zone; and their presence in said zone will tend to adversely effect the economic viability of other uses developed in said zone and thereby contribute to economic decay therein. This economic decay in turn will have an adverse impact on the public health, safety, and general welfare. SECTION 5. Severability. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance, or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions of this Ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this Ordinance, and each section, subsection, subdivision, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions, or the application thereof to any person or place, be declared invalid or unconstitutional.
