Ordinance No. 548ORDINANCE NO. 548 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS AMENDING SECTIONS 16 -8, 16 -10 AND 16 -10.1 OF '_dE CODE OF THE CITY OF CYPRESS CHANGING THE DESCRIPTION OF THE ADVISORY TRAFFIC COMMITTEE TO TRAFFIC COMMISSION. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY DOES ORDAIN AS FOLLOWS: SECTION 1. Section 16 -8 of the Code of the City of Cypress is hereby amended as follows: Sec. 16 -8. Traffic commission -- Established; Composition. There is established hereby an advisory traffic commission consisting of five members, to serve without compensation. The traffic commission shall consist of the city traffic engineer, the chief of police, and three persons appointed by the city council, who shall be residents of the city not holding a position for which compensation is paid by the city. The city traffic engineer and the chief of police each may send a representative to act in his place on the commission, when deemed necessary. The city manager or his representative shall be an ex officio member of the commission and shall act as chairman of the commission, but shall have no vote. SECTION 2. Section 16 -10 of the Code of the Cypress is hereby amended as follows: Sec. 16 -10. Same -- Duties. The traffic commission shall suggest the most practicable means for coordinating the activities of all officers and agencies of this city having authority with respect to the administration or enforcement of traffic regulations; stimulate and assist in the preparation and publication of traffic reports; receive complaints having to do with traffic matters; and recommend to the city council and to the city traffic engineer and other city officials ways and means of improving traffic conditions and the administration and enforcement of the traffic regulations. SECTION 3. Section 16 -10.1 of the Code of the City of Cypress is hereby amended as follows: Sec. 16 -10.1. Same -- Removal. If a member of the advisory traffic commission shall be absent from three (3) consecutive regular meetings of the commission without cause, the office of such member shall be vacant and the term of such member ipso facto terminated, and the city clerk shall immediately inform the city council of such termination. An absence due to illness or unavoidable absence from the city and written notice with explanation thereof to the city clerk on or before the day of any regular meeting by the commission shall be absence for cause. SECTION 4. Severability. If any section, subsection, subdivision, sentence, or portion of this ordinance, or the application hereof or place, is for any reason held to be invalid or uncons by the decision of any court of competent jurisdiction, shall not affect the validity of the remaining portions or its application to other persons or places.
