Ordinance No. 43738C ( ORDINANCE NO. 437 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS _TEMPORARILY PROHIBITING THE ISSUANCE OF ANY BUILDING, GRADING, OR CONDITIONAL USE PERMIT ON CERTAIN PROPERTY FOR A PERIOD OF NINETY DAYS THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY DOES ORDAIN AS FOLLOWS: SECTION 1. Notwithstanding the provisions of Ordinance No. 90, the Zoning Ordinance of the, City of Cypress, for a period of ninety (90) days after the adoption of this urgency ordinance, no building, grading or condi- tional use permit may be issued on that property within the City of Cypress described in Exhibit "A" attached hereto and by this reference incorporated herein. SECTION 2. Where alleged hardship exists the owner or developer of property described within Exhibit "A" for which a building permit, grading permit or conditional use permit is sought may request the City Council to cause such permit to be issued. Upon a finding of sufficient physical or economic hardship the Council may immediately cause said permit to be issued. SECTION 3. Building permit as used in this ordinance includes any building permit, electrical permit, plumbing permit, grading permit or other similar permit required for the construction, installation, repair or reha- bilitation of any structure in any zone. SECTION 4. This ordinance expressly is declared to be an urgency measure designed to preserve the public peace, health, safety and welfare of the resi- dents and property owners within the City of Cypress and shall take effect immediately upon its adoption. SECTION 5. The City Council of the City of Cypress hereby declares that the following facts constitute the urgency requiring this ordinance to take effect immediately as an urgency ordinance: A zoning study is underway regarding rezoning that property described in Exhibit "A" attached hereto and by this reference incorporated herein. Due to the fact that irreparable harm may be done and the effectiveness of the rezoning ordinance seriously impaired this urgency ordinance is made necessary pending the conclusion of the rezoning study. This ordinance will provide the time necessary for the Staff, Planning Com- mission and City Council to determine the proper zone for the subject property and initiate a rezoning thereof.
