Ordinance No. 445ORDINANCE NO. 445 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS ADDING ARTICLE VI TO CHAPTER 2 OF THE CYPRESS CITY CODE, HEREBY ESTABLISHING A RECREATION AND PARKS COMMISSION. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY DOES ORDAIN AS FOLLOWS: SECTION 1: CREATION There is created hereby a Recreation and Parks Commission as provided herein. SECTION 2: COMPOSITION The Recreation and Parks Commission shall consist of seven (7) members. No officers or employees of the City or persons under an employment contract subject to the jurisdiction of the City Council shall be members of such Commission. SECTION 3: OATH OF OFFICE All members of the Recreation and Parks Commission shall be required to take an oath of office as approved by the City Council prior to commencing their term of office. SECTION 4: APPOINTMENT OF MEMBERS The Mayor shall appoint the members of the Recreation and Parks Com- mission, with a 4/5 vote of confirmation by the City Council. The Recreation and Parks Director shall be a permanent ex officio member of the Recreation and Parks Commission and will serve as Secretary to the Commission. The President of the Cypress Teen Club shall be an ex officio member of the Recreation and Parks Commission. No ex officio member of the Recreation and Parks Commission shall be entitled to vote. SECTION 5: TERM OF OFFICE The term of office of the members of the Recreation and Parks Commission first appointed shall be selected by lot, as follows: one for a term of one year; two for a term of two years; two for a term of three years; and two for a term of four years. All succeeding terms shall be for a period of four years. Members shall hold office until their successors are qualified and take office. Members of the Recreation and Parks Commission shall serve no more than two (2) full or partial terms, and such partial terms not to exceed a total of ten (10) years of service. SECTION 6: REMOVAL Members may be removed prior to the expiration of their term by a 4/5 vote of the members of the Council. Absence from three (3) consecutive meetings without cause shall be deemed to constitute the retirement of such member and his position thereafter shall become vacant. SECTION 7: MEETINGS The Recreation and Parks Commission shall meet regularly at least once a month in the Council Chambers in the City of Cypress, except as otherwise provided by law. Special meetings may be called by the chairman or the majority of the members of the commission. All meetings shall be opened to the public except as otherwise authorized by the laws of the State of California. Regular minutes of such meetings shall be maintained by the Commission and available for public inspection at all times. SECTION 8: ORGANIZATION The Recreation and Parks Commission shall elect one of its members as chairman and one of its members as vice - chairman, who shall hold office for one (1) year and until his successor is elected. The Commis- sion shall establish such rules and regulations as it deems necessary for governing itself and for the performance of its duties. Such rules and regulations shall not be inconsistent with laws of the State or the ordinances of the City. SECTION 9: COMPENSATION Members of the Recreation and Parks Commission shall receive such compensation as provided by resolution of the City Council. SECTION 10: DUTIES The Recreation and Parks Commission shall advise the City Council on all matters subject to the jurisdiction of the Council pertaining to acquisition, development and maintenance of public parks and recreational facilities. The Commission also shall advise the Planning Commission on all such matters within the jurisdiction of such commission. The Commission also shall review and advise the Council regarding the financing of and budget for such functions, including but not limited to, the financing and budget of any subsidiary district of the City. The Commission shall also advise the Recreation and Parks Director from time to time. SECTION 11: COMMISSIONER QUALIFICATIONS All members of the Recreation and Parks Commission shall be qualified registered voters.
