Resolution No. 4608347 RESOLUTION NO. 4608 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING THE EXTENSION OF CONDITIONAL USE PERMIT NO. 93 -3 - WITH CONDITIONS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an application was filed for a six (6) month extension of a conditional use permit in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress, in order to allow an existing church use to continue operating pending completion of exterior site improvements at 6381 Ball Road, within the CG- 10,000 Commercial General Zone. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law. 3. That the City Council hereby finds that: a. The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is: Intended as an area for the location of retail and wholesale commercial activities. Public and semi - public uses such as churches are also permitted, subject to a conditional use permit, in this commercial zone. b. The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that: (1) Sufficient access is available to the site off of Ball Road (a primary arterial roadway) and Holder Street (a secondary arterial roadway). (2) As conditioned, the on -site parking for the commercial uses and the church use on -site will be restricted to insure adequate parking availability during the commercial hours of operation. (3) As conditioned, the church project will comply with the Noise Element of the Cypress General Plan Update (1993) and the Noise Ordinance of the Cypress City Code. (4) As conditioned for parking, hours of operation, and noise, the church is compatible with other uses on the subject property and on surrounding properties. (5) As conditioned, approval of the extension of the church use will result in exterior site improvements in compliance with current applicable codes and policies which will upgrade the level of safety and aesthetics of the subject property. c. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve the Extension of Conditional Use Permit No. 93 -3, subject to the conditions attached hereto as Exhibit "A ". 348 PASSED AND ADOPTED by the City Council of the City of Cypress at a regular meeting held on the 25th day of March , 1996. GENERAL CONDITIONS A. The applicant /developer shall comply with all applicable conditions of approval for the Renewal of Conditional Use Permit No. 93 -3 (effective 3- 13 -95), hereby incorporated in this extension by reference. *B. This extension is expressly conditioned upon satisfaction of all applicable conditions of Renewal of Conditional Use Permit No. 93 -3 (effective 3- 13 -95), and of Extension of Conditional Use Permit No. 93 -3 (effective 3- 11 -96), prior to the September 13, 1996 expiration of this extension. Failure to substantially comply with all such conditions may result in the City's initiation of the revocation of Conditional Use Permit No. 93 -3. *C. The applicant /developer shall complete the required exterior on -site and off -site improvements in accordance with the following phasing deadlines: • All required bonds shall be notarized and submitted to the City (as stipulated in existing Condition No. 13) prior to any work commencing under the grading permit. • All necessary site grading (as stipulated in existing Condition No. 2) shall be completed within four (4) months of City Council approval of the subject extension (by 7- 11 -96). • The two (2) accessory structures (identified in existing Condition No. 44) shall be removed within four (4) months of City Council approval of the subject extension (by 7- 11 -96). • All required block wall improvements (as stipulated in existing Condition Nos. 3 and 35) shall be completed within four (4) months of City Council approval of the subject extension (by 7- 11 -96). • The existing pole sign shall be removed and replaced (as stipulated in existing Condition No. 31) within four (4) months of City Council approval of the subject extension (by 7- 11 -96). • All required public improvements (as stipulated in existing Condition Nos. 4, 6, 9, and 10) shall be completed within five (5) months of City Council approval of the subject extension (by 8- 11 -96). Exhibit "A" Extension of Conditional Use Permit No. 93 -3 Conditions of Approval Page 2 • All parking lot resurfacing, striping, and handicapped access improvements (as stipulated in existing Condition Nos. 4, 25, and 26) shall be completed within six (6) months of City Council approval of the subject extension (by 9- 11 -96). • All on -site landscape and irrigation improvements (as stipulated in existing Condition Nos. 27, 28, and 29) shall be completed within six (6) months of City Council approval of the subject extension (by 9- 11 -96).
