A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS GRANTING A
VARIANCE FROM THE TERMS OF THE ZONING ORDINANCE OF THE CITY OF
CYPRESS TO ALLOW A REDUCED SIDEYARD SETBACK FOR A TWO -STORY ROOM
ADDITION.
VARIANCE NO. 94 -4
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:
1. That an application was filed for a variance from the terms of Section 9.2.B.6 of the
Zoning Ordinance of the City of Cypress to allow the construction of a two -story room addition
with a five foot (5') side setback on the first floor and a ten foot (10') setback on the second
floor located at 8571 LaHoma Street.
2. That the City Council, after proper notice thereof, duly held a public hearing on said
application as provided by law.
3. That the City Council hereby finds that:
(a) strict or literal interpretation and enforcement of the specified regulation would result
in practical difficulty for the construction and use of a single - family addition, in that the
narrow width of the lot and the existing three foot (3') side setback of the main structure
would otherwise require an unbalanced design of the addition and reduce open lot area.
(b) strict or literal interpretation and enforcement of the specified regulation would
deprive the applicant of privileges enjoyed by the owners of other properties in the same
vicinity, since similar variances have been granted for other properties in the same zone.
(c) the granting of the variance will not be detrimental to the public health, safety and
welfare, or materially injurious to properties or improvements in the vicinity, because
the second floor windows will meet the required ten foot (10') side setback, will not
create a view into neighboring windows and will overlook an adjacent driveway.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of
Cypress does hereby approve Variance No. 94 -4, subject to the following conditions:
1. The subject variance shall only be valid as provided on the approved site plan. Any further
variances shall require a separate variance application.
2. The applicant shall comply with all applicable conditions for Design Review Committee No.
94 -16 and Conditional Use Permit No. 94 -14.
PASSED AND ADOPTED by the City Council of the City of Cypress at a regular meeting held
on the 26th day of September , 1994.
