RESOLUTION NO. 4424
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS GRANTING A
VARIANCE FROM THE TERMS OF THE ZONING ORDINANCE OF THE CITY OF
CYPRESS TO ALLOW A REDUCTION IN THE REQUIRED LANDSCAPE CURB
ALONG THE EAST BLOCK WALL
VARIANCE NO. 94 -6
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:
1. That an application was filed by S & M Development for a variance from the
terms of the Zoning Ordinance of the City of Cypress Section 14.4.C.8. to allow a two foot
(2') instead of the required three foot (3') wide landscape curb area along the block wall on
the east property line parallel to the driveway located at 5592 Crescent Avenue.
2. That a Negative Declaration was approved and a notice of de Minimis will be
filed according to the requirements of the California Environmental Quality Act.
3. That the City Council, after proper notice thereof, duly held a public hearing
on said application as provided by law.
4. That the City Council hereby finds that:
(a) The narrow width of the lot and the jog in the alignment of the east
property line create a physical hardship and practical difficulty in meeting the
minimum required development standards.
(b) Due to the unusual configuration of the site, the granting of the variance
would not constitute a special privilege to the applicant not enjoyed by other
property owners in the same zone.
(c) While the landscape curb area will be reduced along a portion of the east
property line to two -feet (2') instead of the required three feet (3"), the proposed
landscape curb will adequately buffer the block wall from the driveway and will not
be detrimental to the public health and safety.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the
City of Cypress does hereby approve Variance No. 94 -6, subject to the following conditions:
1. The subject variance shall be subject to and consistent with the final approved site
plan and conditions of approval for Conditional Use Permit No. 94 -16 and Tentative Tract
Map No. 15062.
PASSED AND ADOPTED by the City Council of the City of Cypress at a regular
meeting held on the 12th day of December , 1994.
