Resolution No. 4427RESOLUTION NO. 4427 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING DESIGN REVIEW COMMITTEE PERMIT NO. 94 -25 - WITH CONDITIONS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an application was filed for a design review committee permit in accordance with the provisions of Section 18.2 of the City of Cypress Zoning Ordinance to construct a freestanding monument sign for the Cypress Commercial Center located at 5721 Lincoln Avenue, in the CH Commercial Heavy Zone. 2. That in accordance with the provisions of Section 18.3 the City of Cypress Zoning Ordinance, the Design Review Committee held a meeting on December 29, 1994, at which it conditionally approved the plans and drawings submitted with the application for Design Review Committee Permit No. 94 -25. 3. That the decision of the Design Review Committee on Design Review Committee Permit No. 94 -25 was reported to the City Council at the Council meeting of January 9, 1995. 4. That the effective date of the Design Review Committee's decision shall be the date of acceptance by the City Council and upon receipt by the Planning Department of a signed agreement to any conditions of approval by the applicant. 5. That the City Council hereby finds that: a. The proposed monument sign is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is: Intended to provide appropriately located areas for establishments catering primarily to highway travelers, visitors to the city or such businesses or uses where direct access to major arterial highways is essential or desirable for their operation. b. The proposed location of the project and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that: (1) The monument sign is consistent with the commercial use of the subject property and serves to identify the businesses onsite. (2) The size and scale of the sign and its architectural style is appropriate for the commercial site on which it is located. (3) The sign will be placed in a location which is safe for pedestrians and motorists. (4) The sign will be constructed in accordance with the City's building regulations. c. The proposed project will comply with each of the applicable provisions of the Zoning Ordinance. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Design Review Committee Permit No. 94 -25, subject to the conditions attached hereto as Exhibit "A." 150 PASSED AND ADOPTED by the City Council of the City of Cypress at a regular meeting held on the 9 th day of January , 1995. The applicant shall comply with all applicable provisions of City Code. 2. The subject monument sign shall be constructed only as shown on the approved elevations. The applicant shall obtain a building permit in accordance with the City's building regulations. 3. Prior to the issuance of a building permit for the monument sign the property owner shall remove all illegal signs on the premises of the Cypress Commercial Center.
