RESOLUTION NO. 4428
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING
DESIGN REVIEW COMMITTEE PERMIT NO. 94 -26 - WITH CONDITIONS.
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:
1. That an application was filed for a design review committee permit in accordance
with the provisions of Section 18.2 of the City of Cypress Zoning Ordinance to construct new
fencing, a patio cover and tenant improvements to the existing Boys & Girls Club facility located
at 10161 Moody Street, within the Public /Semi - public Zone.
2. That in accordance with the provisions of Section 18.3 the City of Cypress Zoning
Ordinance, the Design Review Committee held a meeting on November 17, 1994, at which it
conditionally approved the plans and drawings submitted with the application for Design Review
Committee Permit No. 94 -26.
3. That the decision of the Design Review Committee on Design Review Committee
Permit No. 94 -26 was reported to the City Council at the Council meeting of January 9, 1995.
4. That the effective date of the Design Review Committee's decision shall be the
date of acceptance by the City Council and upon receipt by the Planning Department of a signed
agreement to any conditions of approval by the applicant.
5. That the City Council hereby finds that:
a. The proposed improvements to the Boys & Girls Club facility are in
accord with the objectives of the Zoning Ordinance and the purpose of the zone in which
the site is located which is:
Intended to permit adequate identification of areas reserved and developed
for public uses other than street rights -of -way, to provide for expansion
of their operations or change in use, and to identify and preserve areas of
historic and community significance for the enjoyment of future
generations.
b. The proposed location of the project and the conditions under which it
would be operated or maintained will not be detrimental to the public health, safety or
welfare or be materially injurious to properties or improvements in the vicinity in that:
(1) The project improvements, including new fencing, patio cover and
tenant improvements are designed to ensure the safety, security and comfort of
the children and staff using the Boys & Girls Club facility.
(2) The project is compatible with other uses onsite and surrounding
public facilities and residential uses.
(3) The project will be constructed in accordance with all applicable
City building regulations.
c. The proposed project will comply with each of the applicable provisions
of the Zoning Ordinance.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City
of Cypress does hereby approve Design Review Committee Permit No. 94 -26, subject to the
conditions attached hereto as Exhibit "A."
PASSED AND ADOPTED by the City Council of the City of Cypress at a regular
meeting held on the 9th day of January , 1995.

DESIGN REVIEW COMMITTEE NO. 94 -26
CONDITIONS OF APPROVAL
1. Applicant /developer shall comply with applicable provisions of the 1991 Uniform
Building, Plumbing and Mechanical Codes, 1990 National Electrical Code, California
Code of Regulations, Title 24, and the Code of the City of Cypress.
2. Applicant /developer shall comply with all disclosure requirements of the Orange County
Fire Department for hazardous materials use and /or storage and the South Coast Air
Quality Management District for exhaustion of air contaminants.
3. Type 5 cement shall be used for all foundations and slabs on grade.
4. All slabs on grade (including M -1 occupancies) shall receive a minimum of a 10 mil.
moisture barrier.
5. Prior to the issuance of building permits, the applicant shall submit final building
materials and color scheme for review and approval of the Planning Department.
