A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
MAKING STATUTORY FINDINGS APPROVING THE
REDEVELOPMENT AGENCY PAYMENT FOR THE CONSTRUCTION
OF THE CYPRESS SENIOR CITIZENS FACILITY.
WHEREAS, the Community Redevelopment Law of the State of California
(Health and Safety Code Sections 33000 et seq.), among other provisions granting powers
to redevelopment agencies, contains Section 33445 which provides that a redevelopment
agency, with the consent of the legislative body, may pay all or part of the value of the land
for the cost of the installation and construction of any building, facility, structure or other
improvement which is publicly owned either within or without a project area upon a
determination by such agency and such legislative body by resolution that such building,
facility, structure or other improvement is of benefit to such project area and that no other
reasonable means of financing the same are available to the community.
WHEREAS, the officially adopted redevelopment plan of the Cypress
Redevelopment Agency ( "Agency ") for its Civic Center Project Area describes in part for
the construction of a senior citizens community facility in order to provide project area
residents and citizens at large the use of a public facility.
NOW, THEREFORE, the City Council of the City of Cypress ( "City Council ")
does hereby resolve, determine and order as follows:
1. This City Council hereby finds that the facts set forth in the Recitals,
hereinabove are true and correct.
2. This Agency hereby desires to pay for the partial cost of construction
of the Cypress Senior Citizens facility located at 9031 Gindlay Street.
3. This City Council hereby finds that the Redevelopment Plan for the
Civic Center Redevelopment Project Area, as amended and adopted by the City
Council on April 10, 1989 (the "Redevelopment Plan "), makes reference to and
permits the subject Public Improvements.
4. This City Council hereby finds that the subject Public Improvements
are consistent with and made in implementation of the community's public
improvement plans and policies.
5. This City Council hereby finds that there exists no other reasonable
means of financing the Senior Citizens facility.
6. This City Council hereby finds that the Cypress Senior Citizens facility
will be of benefit to the Project Area.
7. This City Council hereby approves the Agency's paying for the cost of
the construction and installation of the subject Public Improvements.
PASSED AND ADOPTED at a regular meeting of the City Council of the
City of Cypress on the 13th day of September , 1993.
