A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
APPROVING CONDITIONAL USE PERMIT NO. 93 -13 - WITH CONDITIONS.
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS,
RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS:
1. That an application was filed for a conditional use permit in accordance with
the provisions of Section 17.2 of the Zoning Ordinance of the City of C ress to establish
an off -site school gymnasium located at 6125 Chip Avenue in the Worland Cypress Business
Park, PC -4 Specific Plan area.
2. That the City Council, after proper notice thereof, duly held a public hearing
on said application as provided by law.
3. That the City Council hereby finds that:
a. The proposed location of the conditional use is in accord with the
objectives of the Zoning Ordinance and the purpose of the zone in which the site is
located is:
Intended to result in a development of a general business - office
character which complements surrounding, existing and planned land
uses.
b. The proposed location of the conditional use and the conditions under
which it would be operated or maintained will not be detrimental to the public
health, safety or welfare or be materially injurious to properties or improvements in
the vicinity in that:
(1) The proposed location of Conditional Use Permit No. 93 -13, off -
site gymnasium, is in accord with the objectives of this ordinance and the
Warland /Cypress Business Park, PC -4 Specific Plan.
(2) The proposed location and the conditions under which it would
be operated or maintained will not be detrimental to the public health, safety,
or welfare, or materially injurious to properties or improvements in the
vicinity because highest traffic volume will occur during non -peak hours.
(3) Under the conditions of approval, any potential increase of
traffic due to special events will be closely monitored for potential traffic
impacts.
c. The proposed conditional use will comply with each of the applicable
provisions of the Zoning Ordinance except for approved variances or adjustments.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the
City of Cypress does hereby approve Conditional Use Permit No. 93 -13, subject to the
conditions attached hereto as Exhibit "A."
PASSED AND ADOPTED by the City Council of the City of Cypress at a regular
meeting held on the 8th day of November , 1993.

CONDITIONS OF APPROVAL
1. Utilities shall not be released until all conditions of approval have been met to the
satisfaction of the Planning Department.
2. All requirements of the Orange County Fire Marshal's Office, Orange County Health
Department, and Cypress Building and Safety Department shall be satisfied prior to
commencement of the business operation.
3. All applicable conditions of Conditional Use Permit No. 93 -13 shall be complied with
prior to occupancy of the subject building.
4. Any expansion or modification of the approved use beyond what is approved as part of
Conditional Use Permit No. 93 -13 will require an amendment to the conditional use
permit.
5. All requirements of the Orange County Fire Marshal's Office shall be complied with prior
to a Certificate of Occupancy being issued.
6. This conditional use permit may be modified or revoked by the City Council should the
Council determine that the proposed use or conditions under which it is being operated
or maintained is detrimental to the public health, safety, or welfare, or materially injurious
to properties or improvements in the vicinity.
7. Onsite security lighting shall be arranged so that direct rays will not shine on adjacent
properties or produce glare for street traffic.
8. Exterior building elevations shall be maintained in a safe appearance such that the
buildings are free of broken, missing or significantly cracked surface finished materials.
9. School buses shall only be parked within the Business Park or at primary site, 6125 Chip
Avenue, for loading and unloading of passengers.
10. School buses parked at Brethren School site shall not interfere with the everyday
operation elimination required parking on the school site. Designated parking for school
buses shall be as illustrated on Conditional Use Permit No. 91 -13, "Shuttle Site Plan."

11. A temporary use permit shall be required for special events other than the sports
program i.e. concerts, graduations. The Planning Director shall approve or deny the
proposed event evaluating it based on the hours of use, type of event, traffic
generation, security and issues pertinent to the proposal.
12. Conditional Use Permit No. 93 -13 shall not be executed until the parking agreements
are approved by the City Attorney for the City of Cypress.
13. Within forty -eight (48) hours of the approval of this project, the applicant /developer
shall deliver to the Planning Department a check payable to the County Clerk in the
amount of Twenty -Five Dollars ($25.00) County administrative fee, to enable the City
to file the Certificate of Fee Exemption in accordance with Fish and Game Code
Section 753.5 with the Notice of Determination required under Public Resources
Code Section 21152 and Title 14 of the California Code of Regulations. If, within
such forty -eight (48) hour period, the applicant /developer has not delivered to the
Planning Department the check required above, the approval for the project granted
herein shall be void.
14. Applicant /developer shall comply with applicable provisions of the 1991 Uniform
Building, Plumbing and Mechanical Codes, 1990 National Electrical Code, California
Administrative Code, Title 24, and the Cypress City Code.
15. Applicant /developer shall comply with all disclosure requirements of the Orange
County Fire Department for hazardous materials use and /or storage and the South
Coast Air Quality Management District for exhaustion of air contaminants.
16. Type 5 cement shall be used for all foundations and slabs on grade.
17. All slabs on grade (including M -1 occupancies) shall receive a minimum of a 10 mil.
moisture barrier.
18. This use will be classified as an A -2.1 occupancy.
19. All exterior doors will be provided with overhead lighting. Exterior doors will have
the lighting activated during all hours of darkness.
20. All exterior doors shall have locking hardware designed to be locked from the
exterior, but unlocked from the interior for exiting purposes.
21. A monitored alarm system, covering all perimeter doors, windows, and roof openings,
including interior protection sensors, shall be installed along with a roof - mounted
light signalling device as approved by the police department.

22. A time -lock delay safe shall be utilized to store monies during and after any event
conducted on the premises.
23. In the training room(s), storage cabinets will have tamper proof doors and locking
hardware in which any and all pharmaceuticals are stored.
24. The pocket door on the west side of facility (adjacent to the existing manufacturing
building) must be permanently secured. (Pg. A2 on plans)
25. Prior to the issuance of any permits, the applicant shall provide to the Fire Chief
plans that indicate the following information:
a. If the structure has existing automatic fire sprinklers, provide the density
calculation.
b. The type of construction of the existing structure. This shall comply with the
Uniform Building Code Sec. 602.
c. The type of construction of the wall between the gymnasium and the
manufacturing tenant.
d. The type of product being manufactured.
e. A letter of intended use from the applicant.
26. The following notes shall be provided on the site plan:
a. Fire Department Final Inspection Required. Schedule inspection 2 days in
advance. Phone 821 -7850
b. Locations and classifications of extinguishers to be determined by fire
inspector.
c. Storage, dispensing or use of any flammable and combustible liquids,
flammable and compressed gasses and other hazardous materials shall comply
with Uniform Fire Code Regulations.
d. Plans of modifications to or new fire protection, detector or alarm system(s)
shall be approved by the Fire Department prior to installation.

27. Prior to the installation of the required fire alarm system for occupancy Group A,
Division 2.1, submit plans to the Fire chief for approval. The system shall be
operational before any Certificate of Occupancy is issued. The alarm shall
immediately initiate an approved prerecorded message announcement using an
approved electrically supervised voice communication or public address system which
is audible above the ambient noise level of the occupancy.
