A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CYPRESS, CALIFORNIA, REVISING
TRAFFIC IMPROVEMENT FEES FOR NEW
DEVELOPMENT /REDEVELOPMENT WITHIN THE
CITY OF CYPRESS
WHEREAS, the City Council of the City of Cypress has adopted Ordinance
No. 911 creating and establishing the authority for imposing and charging Traffic Impact
Fees for new development /redevelopment within the City of Cypress; and
WHEREAS, Ordinance No. 911 provides that the City Council may adopt
by resolution such impact fee structure for such development; and
WHEREAS, the City Council of the City of Cypress has adopted Resolution
No. 4276 providing for Traffic Improvement Fees for such development; and
WHEREAS, as part of those improvements shown to be required in the
specific citywide Traffic Improvement Fee Analysis set forth in Resolution No. 4276, the
estimated mitigation costs of such improvements included the acquisition of right -of -way
on Lincoln Avenue; and
WHEREAS, Resolution No. 4276 provides that the City Council may revise
the Traffic Improvement Fees to incorporate the findings and conclusion of further studies
that have been prepared by the City; and
WHEREAS, on June 27, 1994, the City Council did incorporate the findings
and conclusions of a subsequent Lincoln Avenue right -of -way study which has shown the
elimination of the need to acquire additional right -of -way on Lincoln Avenue;
consequently, reducing the overall mitigation costs; and
NOW, THEREFORE, the City Council of the City of Cypress, California,
does resolve, declare, determine, and order as follows:
Section 1. The City of Cypress hereby revises its Traffic Improvement
Fees shown on Exhibit "A" attached hereto to incorporate the findings and conclusions
of the Lincoln Avenue right -of -way study adopted by the City Council on June 27, 1994.
Section 2. That any fees paid or levied pursuant to that Traffic
Improvement Fee schedule as adopted under Resolution No. 4276 be adjusted to reflect
those shown on Exhibit "A" attached hereto, and that any refunds or credit be issued as
required.
Section 3. The City Clerk shall certify to the adoption of this Resolution
and shall cause the same to be posted as required by law.
PASSED AND ADOPTED by the City Council of the City of Cypress at
a regular meeting held on the 8th day of August, 1994.
