Resolution No. 4288RESOLUTION NO. 4288 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING AMENDMENT TO SPECIFIC PLAN NO. 89 -1 CYPRESS BUSINESS AND PROFESSIONAL CENTER WHEREAS, the City Council of the City of Cypress conducted a public hearing on March 14, 1994, to consider an Amendment to Specific Plan No. 89 -1, known as the Cypress Business and Professional Center located on 298.2 acres of land, as shown on Attachment 1; and WHEREAS, the Amendment to the Specific Plan will allow for the establishment of fairgrounds and accessory uses and entertainment uses to be conditionally permitted for an interim period not to exceed five (5) years; and WHEREAS, the Amendment to the Specific Plan also provides that the development standards and site improvements required by the Specific Plan shall be reviewed and subject to possible phasing as determined by City staff on a case -by -case basis; and WHEREAS, after a thorough analysis by the City Council of the City of Cypress concerning the proposed amendment to the Specific Plan's future impact on the existing and surrounding land uses within and adjacent to the Cypress Business and Professional Center Specific Plan area, a motion was made to approve Amendment to Specific Plan No. 89 -1, establishing general provisions allowing for fairgrounds and accessory uses and entertainment uses to be conditionally permitted for an interim period; and WHEREAS, the City of Cypress has adopted a finding of de Minimus impact on wildlife and approved the Negative Declaration in accordance with the requirements of the California Environmental Quality Act (CEQA); and WHEREAS, the City Council of the City of Cypress desires to approve Amendment to Specific Plan No. 89 -1; and WHEREAS, after discussion by the City Council with the citizens affected by this Specific Plan, a motion was made to approve Amendment to Specific Plan No. 89 -1. NOW, THEREFORE, be it resolved by the City Council of the City of Cypress that: 1. The City Council finds that Specific Plan Amendment No. 89 -1 is consistent with the goals and policies of the Cypress General Plan. 2. The City Council finds that Specific Plan Amendment No. 89 -1 is consistent with the goals, policies, and objectives of the Cypress Business and Professional Center Specific Plan. 3. The City Council finds that sufficient data exists to permit a finding of no significant negative environmental impacts and, therefore, has approved a negative declaration for this project. 4. The City Council finds that only those uses within the category of "fairgrounds and accessory uses and entertainment" are appropriate for consideration of interim conditional approval periods. 5. The City Council finds that the appropriate maximum time period to conditionally permit interim uses is not to exceed five (5) years. 6. The City Council finds it appropriate that development standards for a conditionally approved interim use may be phased and or waived for interim uses to be determined on a case -by -case basis. NOW, THEREFORE, be it resolved that the City Council of the City of Cypress DOES HEREBY APPROVE this Amendment to Specific Plan No. 89 -1. PASSED AND ADOPTED by the City Council of the City of Cypress at a regular meeting held on the 28thday of March, 1994.
