Resolution No. 4290178 RESOLUTION NO. 4290 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING CONDITIONAL USE PERMIT NO. 94 -5 - WITH CONDITIONS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an application was filed for a conditional use permit in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress to construct a pump station at the southeast corner of Denni Street and Avenida Granada, within the PC -7 Zone. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law. 3. That the City Council hereby finds that: a. The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located in that: The PC -7 Zone is intended to provide for the classification and development of parcels of land as coordinated, comprehensive projects so as to take advantage of the superior environment which can result from large -scale community planning; to allow diversification of land uses as they relate to each other in a physical and environmental arrangement, while ensuring substantial compliance with the provisions of the ordinance; and to provide for a zone encompassing various types of land uses, such as single - family residential developments, multiple housing developments, professional and administrative office areas, commercial centers, industrial parks or any public or semi - public use or combination of uses through the adoption of a development plan and text materials which set forth land use relationships and development standards. b. The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that: (1) The proposed location of Conditional Use Permit No. 94 -5, the Sorrento Pump Station, is in accord with the objectives of the City of Cypress Zoning Ordinance Section 17.2 Conditional Uses and the purpose of the zone in which the site is located because conditions have been imposed to regulate and ensure compliance with the Sorrento Specific Plan. (2) The proposed location of the pump station and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity and, in fact, the purpose of the project is to improve an existing deficiency in the local and regional drainage system. (3) The proposed pump station will be designed and regulated for compliance with the Noise Ordinance Section 13.68 of the Cypress Municipal Code. (4) The proposed pump station is consistent with the City of Cypress General Plan Open Space criteria in that the pump station complies with the allowable land area designated for this use. c. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Conditional Use Permit No. 94 -5, subject to the conditions attached hereto as Exhibit "A." Landscaping Plans shall be submitted to the City for review and compliance with the Sorrento Landscaping Plan. The type and quality of the proposed landscaping shall further conceal the visibility of the pump station and its surrounding wall at the street level and the view from the second story of the surrounding homes. 2. A temporary sign shall be installed designed and developed by a professional sign designer, announcing the project, identifying the source of funds and the agency(ies) responsible for the project implementation. FIRE DEPARTMENT 3. Prior to the issuance of any building permits for combustible construction, a letter and plan from the developer shall be submitted to and approved by the Fire Chief. This letter and plan shall state that the water for fire fighting purposes and an all weather fire - access road shall be in place before any combustible materials are placed on the site. Indicate on the site plan any existing fire hydrants. 4. Prior to the issuance of any building permits, the applicant shall submit a detailed letter of intended use for each building. Include how the pump station will be powered. 5. Prior to the issuance of any building permits, construction details for emergency access gate shall be submitted to and approved by the Fire Chief. Contact the Orange County Fire Department at (714) 744 -6623 for a copy of the "Guidelines for Fire Department Emergency Access." 6. Prior to the issuance of any building permits, contact the Orange County Fire Department Hazardous Materials Disclosure Office at (714) 744 -0463 to obtain a "Hazardous Materials Business Information and Chemical Inventory Packet." This shall be completed and submitted to the Fire Chief before the issuance of any building permits. 7. Prior to the issuance of any grading permits, the applicant shall submit to the Fire Chief a list of the quantities of all hazardous, flammable and combustible materials, liquids or gases. These liquids and materials are to be classified according to the Orange County Fire Department Chemical Classification Handout. Provide a summary sheet listing each • Community Development Department • Planning Division • Exhibit "A" Conditional Use Permit No. 94 -5 Conditions of Approval Page 2 hazard class, the total quantity of chemicals used in that class. All forms of materials are to be converted to units of measure in pounds, gallons and cubic feet. Compressed gases and compressed liquified gases are to be converted to feet. 8. The following notes shall be provided on the site plan: Fire Department Final Inspection Required. Schedule inspection 2 days in advance. Phone (714) 821 -7850. BUILDING DIVISION 9. Applicant /developer shall comply with applicable provisions of the 1991 Uniform Building, Plumbing and Mechanical Codes, 1990 National Electrical Code, California Code of Regulations, Title 24, and the Code of the City of Cypress. 10. An automatic fire sprinkler system, approved by the Fire Marshal, may be required. 11. Applicant /developer shall comply with all disclosure requirements of the Orange County Fire Department for hazardous materials use and /or storage and the South Coast Air Quality Management District for exhaustion of air contaminants. 12. Type 5 cement shall be used for all foundations and slabs on grade. 13. All slabs on grade (including M -1 occupancies) shall receive a minimum of a 10 mil. moisture barrier. 14. A soil investigation report shall be submitted with the plans for plan check. Report shall include soil bearing capacity, seismic study, grading, paving, sulfate test and other pertinent information under good engineering practice. 15. An acoustical report shall be submitted with the plans upon entering plan check. Report shall meet all the requirements of the Uniform Building Code, Title 24 of the State Administrative Code and the Cypress Noise Ordinance Section 13. of the Cypress Municipal Code. 16. A noise propagation study shall be performed to evaluate the pump vibration or sound transmissions through the water table. These situations shall be addressed and solutions provided in the report upon submittal of plans check documents. CODE ENFORCEMENT 17. Landscaping shall be installed to prevent graffiti. Plant materials shall be included upon submittal of landscaping plan. • Community Development Department • Planning Division • 182 Exhibit "A" Conditional Use Permit No. 94 -5 Conditions of Approval Page 3 PLANNING DEPARTMENT 18. A detailed landscape and irrigation plan shall be submitted to the Planning Department for review and approval at least sixty (60) days prior to issuance of a Certificate of Occupancy. In addition, a bond shall be posted with the Public Works Department to guarantee against defects in plant materials and workmanship. 19. Landscaping irrigation pipes and sprinkler heads shall be maintained in good working order so as to cover all landscape areas. 20. The operation of the pump station shall comply with Municipal Code Section 13.68 Exterior Noise Standards. Applicant shall submit noise ratings and pertinent mitigation measures for compliance with the noise ordinance. 21. All architectural treatments shall comply with the Sorrento Specific Plan. 22. Landscape materials shall comply with the Sorrento Specific Plan landscape criteria. 23. Architectural elevations and a final site plan shall be reviewed and approved by the Design Review Committee in conjunction with the Planning Department prior to the issuance of building permits. 24. Onsite security lighting shall be arranged so that direct rays will not shine on adjacent properties or produce glare for street traffic. 25. Exterior building elevations shall be maintained in a safe appearance such that the buildings are free of broken, missing or significantly cracked surface finished materials. 26. Conditional Use Permit No. 94 -5 shall not be effective until release and approval of final design by the City of Cypress. 27. Final design of Pump Station shall be subject to review of the Design Review Committee and final review by City Council. ENGINEERING DEPARTMENT 28. The developer shall conform to all applicable provisions of the Code of the City of Cypress and all standards of the Engineering Department pertaining to the development and design of the proposed pump station.
