Resolution No. 4336RESOLUTION NO. 4336 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING DESIGN REVIEW COMMITTEE NO. 94 -11 - WITH CONDITIONS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an application was filed for a Design Review Committee in accordance with the provisions of Section 18 of the Zoning Ordinance of the City of Cypress to review the precise site plan and building elevations for the Los Alamitos Race Track Swap Meet located at 5303 Katella Avenue in the PBP Planned Business Park Zone. 2. That the City Council hereby finds that: a. The proposed location of the use is in conformity with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is: Intended to provide for the classification and development of parcels of land as complete, comprehensive, and integrated projects so as to take advantage of the superior environment which can result from large scale community planning, and thereby reduce adverse environmental impacts of uncoordinated development. Additionally, this zone is intended to provide for a zone encompassing various types of land uses such as education, professional and administrative office, commercial centers, industrial parks, open space, or any public or semi - public use or combination of uses through 1) established zoning mechanisms and criteria as set out in the PC (Public /Semi - Public Zone; or 2) the adoption of a specific plan and text materials which set forth land use relationships and development standards. b. The proposed location of the use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that: (1) The proposed project is consistent with the goals, policies, and objectives of the Cypress Business and Professional Center Specific Plan as amended and the Cypress General Plan. (2) The location of the use and the conditions under which it will be operated will not be detrimental to the public health, safety and welfare, since the proposed Swap Meet use will be required to comply with conditions of approval, including annual review of all operations, subject to the conditions attached hereto as Exhibit "A." (3) The proposed buildings and landscaped areas have been designed to enhance the visual and physical use of the property and to screen deleterious uses. c. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Design Review Committee No. 94 -11, subject to the conditions attached hereto as Exhibit "A." The developer shall conform to all applicable provisions of the Code of the City of Cypress. 2. The final parking lot layout and ingress and egress plan shall conform to the requirements of the traffic control plan and be approved by the Director of Public Works at least one week prior to the operation of the Swap Meet. PLANNING CONDITIONS 3. Swap Meet personnel shall remove any and all trash, debris, litter and dumpsters associated with the Swap Meet use on Katella Avenue and Walker Street by 7 p.m. on each day the Swap Meet is in operation. 4. The applicant shall submit detailed building elevations showing exterior materials and dimensions for review and approval by the City Council at the June 27, 1994, City Council meeting. The applicant must receive City Council approval of the exterior elevations and materials prior to the installation thereof. 5. All roof mounted equipment shall be adequately screened from the public view subject to the approval of the City staff. 6. A detailed landscape and automatic irrigation plan shall be submitted to the Planning Department for review and approval at least seven (7) days prior to the installation of any plant material. Proposed landscape material, berming and fencing shall conform to the Cypress Business and Professional Center Specific Plan. In addition, a bond shall be posted with the Public Works Department to guarantee against defects in plant materials and workmanship. 7. All vendors shall enter the site from Walker Avenue only, and staging of vendor vehicles and related equipment shall only occur in the northeast corner of the development. The Katella Avenue point of ingress and egress shall not be used as an entrance for any vendors at any time. • Community Development Department • Planning Division • 336 Exhibit "A" Design Review Committee No. 94 -11 Conditions of Approval Page 2 8. The developer shall ensure that no stacking occurs on Katella Avenue and that proper traffic control measures are used during peak congested periods or when there are multiple events occurring at the Los Alamitos Race Track facility. The developer shall submit a traffic control plan subject to the review and comment by the City of Los Alamitos City Engineer, prior to the commencement of operations. 9. A traffic mitigation fee shall be paid to the City of Los Alamitos in accordance with the Cypress Business and Professional Center Traffic Mitigation Agreement for the restroom facilities, the concession building, and any other permanent improvements, prior to the issuance of a building permit or construction, whichever occurs first. 10. A drainage plan and traffic control plan shall be submitted for review and comment to the City of Los Alamitos City Engineer prior to the commencement of operations at this site. 11. Setup by vendors shall be prohibited from occurring prior to 6 a.m. Setup operations shall be subject to the City of Cypress Noise Ordinance. 12. The applicant shall repair any damage caused to the City of Los Alamitos right -of -ways caused by on -site operations. 13. Within forty -eight (48) hours of the approval of this project, the applicant/developer shall deliver to the Planning Department a check payable to the County Clerk in the amount of Twenty-Five Dollars ($25.00) County administrative fee, to enable the City to file the Notice of Fee Exemption in accordance with Fish and Game Code Section 753.5, required under Public Resources Code Section 21152 and Title 14 of the California Code of Regulations. If, within such forty -eight (48) hour period, the applicant /developer has not delivered to the Planning Department the check required above, the approval for the project granted herein shall be void. 14. Vender ingress and egress shall be reviewed within 90 days of the commencement of the Swap Meet. 15. If any noise complaints are received, the City Council shall be notified immediately and City Council may consider this matter and modify design review committee conditions of approval as deemed necessary.
