Resolution No. 406873 RESOLUTION NO. 4068 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPOINTING A HEARING BODY FOR PURPOSES OF DETERMINING NON - CONFORMING USES, STRUCTURES, SCREENING, PERFORMANCE STANDARDS, AND SIGNS PURSUANT TO SECTION 16 ET SEQ. OF APPENDIX I, "ZONING," OF THE CODE OF THE CITY OF CYPRESS WHEREAS, Section 16.11 of Appendix I, "Zoning," of the Code of the City of Cypress empowers the City Council to appoint a hearing body for the purposes of determining non- conforming uses, structures, screening, performance standards, and signs; and, WHEREAS, the City Council has determined to appoint a hearing body comprised of citizens and staff members; and, WHEREAS, Section 16.11 of Appendix I, "Zoning," of the Code of the City of Cypress requires such a designation to be made by Resolution of the City Council. NOW, THEREFORE, the City Council of the City of Cypress does hereby resolve, determine, find, and order as follows: SECTION 1. Pursuant to Section 16.11, "Hearing Body Designated; Hearing," of Appendix I, "Zoning," of the City Code of the City of Cypress, there is hereby established a hearing body to be composed of the following members: (a) Three (3) members of the general public to be ap- pointed by the City Council; and, (b) The Director of Planning; and, (c) The City Manager /Designee. SECTION 2. The Hearing Body for Non - Conforming Uses, etc., shall meet at least annually on the first Monday of February of each calendar year. Thereafter, the Non - Conforming Uses Hearing Body shall meet as needed as determined by the Planning Director, the Hearing Body's Chair, or a majority of its membership. SECTION 3. The Non - Conforming Uses Hearing Body shall select one of its citizen appointees to serve as chair, and one of its citizen members to serve as vice - chair. The Planning Director's Secretary shall serve as the Secretary to the Non - Conforming Uses Hearing Body. The Planning Director shall be responsible for providing the notices required in the City Code, and for providing the backup material and documentation to the Hearing Body. The City's Code Enforcement Staff shall be available to present the information to the Hearing Body with such other necessary City Staff, including Planning Staff, as sufficient to present the City's case. SECTION 4. The Hearing Body shall conduct its meetings and its public hearings in accordance with the procedures adopted by the City Council for the conduct of its meetings in the Code of the City of Cypress and for conducting its hearings -1- '7 9 as set forth in the Public Hearing Procedures adopted by Resolution of the City Council. All such meetings shall be open and public and subject to the provisions of the Ralph M. Brown Act. SECTION 5. The City Clerk shall certify as to the adop- tion of this Resolution, and shall begin soliciting applica- tions for interest in serving on the Non - Conforming Uses Hearing Body.
