Resolution No. 6599455 RESOLUTION NO. 6599 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING AN AMENDMENT TO THE LINCOLN AVENUE SPECIFIC PLAN TO ESTABLISH A COMMERCIAL PRESERVATION OVERLAY DISTRICT AND TO LIMIT THE HEIGHT OF RESIDENTIAL USES TO 30 FEET WITHIN THE COMMERCIAL MIXED -USE, CAMPUS VILLAGE, AND PUBLIC AND SEMI - PUBLIC ZONING DISTRICTS WHEREAS, Policy 4.1 of the Lincoln Avenue Specific Plan calls for the re- evaluation of the mix of land uses and development incentives every five years. WHEREAS, the City Council directed staff to conduct a five -year review of the land uses contained within the Land Use Matrix of the Lincoln Avenue Specific Plan; and WHEREAS, on February 1, 2016, city staff consulted with its retail consultant to identify the properties along the Lincoln Avenue to preserve for commercial uses only, and WHEREAS, a commercial preservation overlay zone was prepared to preserve selected properties for commercial uses only; and WHEREAS, on April 11, 2016, city staff presented its five -year review of land uses to the City Council, including the option of creating a commercial preservation overlay district and a restriction on the height of new residential development within the Commercial Mixed -Use, Campus Village, and Public and Semi - Public zoning districts; and WHEREAS, on April 11, 2016, the City Council directed staff to prepare modifications to the Lincoln Avenue Specific Plan to preserve the properties identified in the report for commercial uses only, and reduce the residential building height in the Commercial Mixed -Use, Campus Village, and Public and Semi - Public zoning districts from 50 feet to 30 feet; and WHEREAS, on November 14, 2016, the City Council of the City of Cypress considered all evidence presented by the applicant, city staff, and other interested parties at a public hearing; and WHEREAS, the City Council of the City of Cypress desires to maintain existing viable commercial properties and limit the height of future residential development along the Lincoln Avenue corridor; and THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. The City Council, after proper notice thereof, duly held a public hearing on November 14, 2016, regarding said amendment as provided by law. 2. The City Council hereby finds that in accordance with the California Environmental Quality Act (CEQA), an addendum to the 2009 Negative Declaration was prepared in accordance with section 15162 of the CEQA Guidelines. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress considered the addendum to the 2009 Amendments Negative Declaration and approves Specific Plan Amendment 2016 -01. Any challenge to this Resolution, and the findings set forth therein, must be filed within the 90 day statute of limitations set forth in Code of Civil Procedure 1094.6.
